How to Become a Legal Guardian

Adult children caregivers responsible for the care of aging parents often ask how to become a legal guardian? Pamela D Wilson, the caregiving expert who served as a professional guardian for the elderly and disabled, shares practical information about the guardianship process. Becoming a legal guardian for an elderly parent, spouse, or another adult is a serious responsibility.

Court appointed guardians, whether family or professional, are held to high standards of care that include developing a care plan and an annual budget for care costs and living expenses. Many family members become guardians, knowing little about the legal role or the expectations of the court system.

Becoming Court Appointed Guardian for Elderly Parents

Becoming a court appointed guardian for elderly parents can be an overwhelming experience, especially if elderly parents with dementia or Alzheimer's are refusing care and lack an understanding of the need for involvement by an adult child. Family disagreements may also happen over which child should be appointed.

While some families proceed through the guardianship process without an elder law attorney, there are many situations where legal advice is beneficial. During her career as a professional fiduciary, Wilson supported families through the steps for how to become a legal guardian. She also served as guardian in family situations where disagreements or qualifications resulted in the court appointing a professional. 

In this radio program for caregivers, Wilson clears up the question some family members ask about the requirement of a guardian being an attorney. Wilson's extensive background in care management, working with adult protective services, and attorneys led to a twenty-plus year career that included being a professional guardian.

Wilson no longer serves as a court appointed guardian, however, she remains a member of the Colorado Bar Association Elder Law Section. She holds certifications as a national certified guardian and a certified senior advisor. Her focus today is on education for caregivers through corporate and group programs.

Bernardo Reyes, MD, CMD., is a board-certified Internist and Geriatrician. He is an Assistant Professor of Geriatrics at the Charles E. Schmidt College of Medicine at Florida Atlantic University where he serves as the Director of the Geriatric and Palliative Rotations and Associate Director of the Internal Medicine Residency Program. In this role, Dr. Reyes oversees the learning experience of our Internal Medicine Resident Physicians.  Dr. Reyes is also the attending physician for our Inpatient Geriatric Service at Delray Medical Center and preceptor at our Residents Outpatient Clinic in Boca Raton. 

His scholarly activity includes seven chapters in textbooks, editorials, and letters to the editor in different journals, including the New England Journal of Medicine, original peer-reviewed research publications, as well as multiple posters and oral presentations in regional, national and international venues.  His research portfolio focuses on safe transitions of care of at-risk older adults and early identification of sepsis in the post-acute setting. In addition, he designed and implemented an international exchange program between FAU and Universidad de Navarra for FAU students to learn Medical Spanish and the differences between the health care systems in Europe and the US.
