I admit I was depressed all day when I heard & saw that Amona was scheduled to be evacuated & demolished before the Supreme Court had so degreed. I didn’t do anything because I really only wanted to be there in Amona. Since I couldn’t, I was immobilized all day. Then I read what my hero from many years ago, Daniella Weiss said, & I was inspired & re-invigorated. That’s the true power that heroes & heroines have.

Daniella may be wrong about the government falling….However, IF they take their courage in hand to adopt the Levy Report, they may have a good chance at success in defeating even world opinion – spread by ‘fake news’ that the Land under the soil of Judea & Samaria belongs ‘allegedly’ to Arabs who call themselves‘Palestinians’ after the name the Romans gave the Jewish Land of Judea when they destroyed Jerusalem in 70 CE.

The Leftist Supreme Court has adopted Ottoman Law, & British Law, & Jordanian Law. Is that any way for a Jewish Supreme Court of Israel to rule the Jewish State of Israel?

What proofs have the Leftist Yesh Din brought to prove the Arab ownership of this Land which they did not even build homes on or plant farms & orchards – as did the Jews who have returned to our ancient Homeland…as they descended from the indigenous people of the Land, the oldest, indigenous people of Eretz Yisrael.

Now is the hour & the time of our destiny to assert our real power over this ancient Land of Ours – by right, by law, by Torah & by our blood, sweat & tears we poured into our soil. Let the pioneers of Amona & Ofra rebuild a new town & teach the rest of us the power of building our own homes on our own Land…with Sovereignty Now – from the River to the Sea.

Daniella Weiss, leader of the settlement movement Nachala, estimates in an interview with Arutz Sheva that the Amona evacuation & house demolition in Ofra will bring down the government.

“Unfortunately, the Right-wing parties represent today the cold, pragmatic approach – & just as the National Religious Party after the destruction of Yamit crashed & Fuad Ben Eliezer crashed after harming Havat Gilad, the Likud & the Jewish Home are likely to crash,” says Weiss.

“Whoever lays a hand on the Land of Israel has no chance to lead the people of Israel. The investigations against the Prime Minister are in every way connected to the weakness he demonstrates in relinquishing parts of the homeland. It weakens him & his weakness is therefore exploited,” she added.

Weiss calls upon the Likud & Jewish Home to immediately adopt the Edmond Levy Report. Just as [Ariel] Sharon brandished his finger & adopted the Talya Sasson report that led to scores of communities in Judea & Samaria becoming illegal, so can Netanyahu adopt the Levy Report.”

She added that a right-wing government should not act as it does, against the background of a US administration that supports Israel having been elected.

“They’re continuing the same track that brought about the prolonged construction freeze in Judea & Samaria and to question marks over Jerusalem. Trump took power & threw us the crumbs of thousands of housing units. Did we wait for Trump in order to build a teeny bit in Jerusalem? Is this what a right-wing coalition can do in this historical moment? There is a great moral issue here. This is betrayal of the Land of Israel by the government of Israel,” said Weiss.

She argues that “to take a part of the Land of Israel & concede it as private [Arab land], when the entire thing is a Jordanian deception – this is moral bankruptcy. So they will not last. Not because of the investigations, but because of infidelity to the Land of Israel”.

Despite the efforts of the Netanyahu government to find alternative housing for the evicted Amona residents, the High Court of Justice sided with leftist NGO Yesh Adin and rejected the plan.

The High Court of Justice on Wednesday rejected a government proposal for Amona, casting an additional pall over the future for former residents of the community. The ruling sent a clear message that the court will declare a bill aimed at legalizing expropriated communities in Judea and Samaria illegal should the Knesset vote it into law.

Instead, the court accepted a petition by Yesh Din, a left-wing Israeli NGO whose stated mission is “to oppose the continuing ‘violation of Palestinian human rights in the Occupied Palestinian Territory’… by raising public awareness of such violations, and by applying public and legal pressures on government agencies to end them.”

In mid-December, Amona residents approved a compromise deal that offered a relocation deal for 24 of the 40 families at an adjacent plot regulated as “absentee property” but the deal was on hold since January 23, while the Court considered a petition filed by residents of the ‘Palestinian’ village of Silwad and the Left-wing legal rights NGO Yesh Din.

The replacement plots for the evacuated Amona residents were located on what was considered unclaimed land & were to be incorporated as state land through the Absentee Property Law. Palestinians from Silwad are now claiming ownership. [Gail Sez: PROVE IT!]

In the petition, accepted by the court, Yesh Din claimed that the plots of land which the State had set aside to construct alternative housing for the residents of Amona consisted of ‘privately’– owned Arab land.

In response to the decision, Education Minister Naftali Bennett, head of the Jewish Home party, told Israel Army radio that the only “Zionist response” would be for the government to authorize the establishment of a new settlement for the evicted families, the first in 25 years. Prime Minister Benjamin Netanyahu formed a team on Wednesday evening, with the evacuation of Amona still ongoing, whose task it will be to work towards that goal.

Challenging the High Court ‘Dictatorship’

Regavim, the National Land Protection Trust, blasted the court decision Wednesday, arguing that it does not treat unrecognized Jewish towns in Judea and Samaria according to the same standards it applies to illegal construction in unrecognized Bedouin villages in the Negev.

“Regarding the Amona affair, the High Court was never content – going until the demolition of houses even considering the many petitions that were filed on behalf of Amona landowners proving there was no dispute over their true ownership,” Regavim stated. “Today will be remembered as the day the High Court singlehandedly caused a further erosion in public confidence in the judicial system.”

The Supreme Court judges are appointed on the basis of seniority and are not vetted by the Knesset – an issue that several politicians and lay people have been attempting to change in recent years, noting the power of the court to overrule government decisions, as in the case of Amona. Many have challenged the status quo. Attorney Yoram Sheftel, for instance, already in 2011 stated that “a group of leftists joined together to form a Supreme Court dictatorship,” noting that in the US, a federal judge is subject to a hearing of the Senate Constitutional Committee.

“The supreme court has gutted the ability of any elected government actually to govern, and ended up undermining rather than protecting both human rights and the rule of law,” remarked political commentator and former legal reporter Evelyn Gordon, in a recent essay in Mosaic Magazine. Security forces on Wednesday night evicted the residents of the last house in Amona which had yet to be evacuated.

Dozens of youths remain in the town’s synagogue & police are making preparations to evacuate them on Thursday morning.

Police said before midnight that dialogue was continuing with those in the synagogue “out of a desire for an agreed upon evacuation that will maintain the sanctity of the place. We hope that these efforts will bear fruit & all will end in peace.”

Earlier on Wednesday evening, the Supreme Court struck down the draft plan agreed to by the residents of Amona and the government last month, which would have provided alternative housing for the residents who are being evacuated from their homes.

The Court accepted the petition by the Leftist organization Yesh Din, which argued that the plots of land which the State had set aside to construct alternative housing for the residents of Amona through the use of the absentee property law, was private Arab land.

MK Moti Yogev (Jewish Home) slammed the court’s decision. “The Supreme Court, whose political composition is determined by Chief Justice Miriam Naor, outlawed a step which could have alleviated this injustice [of evacuating Amona residents].

“Do not worry. We do not only pray ‘Restore our judges as in times of old’ (a Jewish prayer). We will act in every way to curb the dictatorship of the Supreme Court, the ‘High Court of Injustice,’ & to restore democracy to the State of Israel.”

Education Minister Naftali Bennett (Jewish Home) said that “In light of the Supreme Court’s decision, the government must approve the construction of a new town for the residents of Amona. That would be an appropriate Zionist response & we must implement it as soon as possible.”

The evacuation of Amona began Wednesday morning. 11 families were evicted from their homes. United Hatzalah stated that it treated 26 people for hypothermia & injuries in Amona. The police stated that at least 15 police officers were lightly injured & that at least 15 protesters were arrested.

No construction had begun on plots of land agreed upon by the residents & the government because of Yesh Din’s petition & the residents of Amona are left without housing.
