Bill Cosby Sentenced to 3 to 10 Years of State Custody

So we now know that Bill Cosby got sentenced to 3- to 10 years of state custody in Pennsylvania. But lets take a look at the facts that led to that.

Okay so to start with, the Cosby was found guilty by a jury so it's not like he took a Guilty Plea and Pled out. He may have only been convicted of 1 victim, but there's lots of evidence shows there maybe possibly 60 more victims give or take. And those kinds of facts hurt him a lot whether he was convicted of them or not, because it shows his character and his predisposition to sexually assault women.

Then there's the fact Cosby never accepted responsibility for anything and went off on Judge O'Neill calling his character into question.  That's the last thing any smart defendant should do is berate the judge at sentencing prior to the gavel coming down.

So now Cosby's 81 years old. This Judge had a lot of leeway according to Pennsylvania law. He could have given Cosby anything from house arrest up to 20 years based on the conviction. But if you take the 60 other alleged victims, O'Neil could have stacked 1 year on to the sentence for each and every one of them based on relevant conduct and that's a lot of years.

So what the judge did was sort of a balancing act and took several issues into consideration.

First off, is Cosby guilty: Yeah, no doubt about that! Found guilty by a jury.

Secondly is Cosby a threat to the community and likely to recommit his crimes? NO extremely unlikely. They got this guy under a microscope.

But since Cosby had been found guilty he had to be punished for his crimes. He may be 81 and blind now, but when he was out there molesting women and slipping them Quaaludes to knock them out, and when sexually assaulted 29 year old Andrea Constand back in 2004 he wasn't old and blind, so the law allowed him to be punished based on what he did then, not what his condition is now.

The judge could give him probation, but what kind of deterrence would that be for other people out there committing rape right now. Turns rape into a joke without consequences. That's what sentencing is about, punishment and deterrence. The term penitentiary stands for Penance.

SCI Phoenix is the Phoenix is the Pennsylvania DOC's reception center where state inmates go for classification and the real deal.  Where touches down after that is pretty much up in the air. They could throw him in PC, that's Protective custody to keep him safe from the possibility other inmates assaulting him because he doesn't have a real popular crime.

It doesn't really matter where he goes because at his age his days are numbered and his quality of life as an inmate will wear him down quick. It's a strong possibility….the only way he's going home is in a box!
