FIVE REASONS WHY THE MICHAEL JACKSON JURY FAILED TO CONVICT Beverly Hills, California) "The verdict that stunned the world, perhaps stunned Michael Jackson the most," observes Carole Lieberman, M.D., the psychiatrist and expert witness who filed the first complaint with Child Protective Services that launched the investigation into the 'current accuser'. What went wrong? Here are 5 reasons why the Michael Jackson Jury failed to convict: 1. The Timeline: "Although I was shocked at the end, that there was not one guilty verdict, I had actually predicted that the timeline would be the fatal flaw and had told Tom Sneddon this, over one year ago," reports Dr. Lieberman. "But Mr. Sneddon chose to charge him only with the molestations that occurred after the "Living with Michael Jackson" documentary aired, undoubtedly to try to avoid explaining why the boy did not admit this originally. Although Michael may well have continued molesting the boy afterwards, it is not credible that he would have first begun then, when he was under scrutiny" Indeed, when asked about the timeline, jurors said, "That was very confusing…. The timeline was a concern" 2. Celebrity: As we learned from the O.J. trial, celebrities with legal dream teams can get away with murder. "Michael Jackson was not only a celebrity, but he was 'their' celebrity, their neighbor. Because of the international invasion on small town Santa Maria, the jurors developed a 'them against the world' mentality and protected Michael" 3. The Mother: The jurors' press conference, after the verdict, gave away their real reason for not convicting Jackson. "Tight-lipped until asked for their opinions about the accuser's mother, jurors suddenly burst forth with, 'What mother in her right mind would allow that to happen?' Allow what to happen? If Michael wasn't guilty, what was there to happen?" Dr. Lieberman points out. "They punished the boy twice: once for having to grow up with a mother who 'sold' him to MJ, and once for having the courage to come forward and tell" The defense successfully galvanized the jury to blame the mother for the molestation, instead of Jackson. 4. The Prosecution Experts: "The psychologist who examined the boy, did a very poor job all the way around. He obviously did not spend enough time providing therapy to the boy. If he had, the boy would have gained more insight into his experiences with Michael, and would have become more comfortable in his own skin, such that he wouldn't have come off as defensive and arrogant to the jury. If he was more in touch with his feelings, the jury would have found him more sympathetic and believable" In molestation trials, the victim should be the most compelling witness and the psychiatric expert witness the next most compelling, articulately putting the whole story together so that it becomes unmistakable to the jury. This was the missing link in the trial. 5. Witnesses & Testimony MIA: A Vanity Fair article, which reported allegations of Brian Oxman offering Jordie Chandler a blank check not to testify was a case of too little, too late. He not only did a disservice to the current accuser, and other accusers, but he did the greatest disservice to himself.
