Lamar Odom and Khloe Kardashian May Not Be Able To Use A Prenuptial Agreement

Los Angeles Lakers star Lamar Odom and reality TV personality Khloe Kardashian have announced that they are getting married this Sunday, September 27th. The pair reportedly started dating six weeks ago, and he is said to want to get married before the Lakers start their season on October 7th.

According to attorney Evan T. Sussman, a Certified Family Law Specialist practicing in Beverly Hills, "the Odom/ Kardashian wedding is a textbook example of one in which a prenuptial agreement should be considered." Mr. Odom signed a multimillion dollar contract extension with the Los Angeles Lakers earlier this summer, and Ms. Kardashian also may have significant business interests. " A prenuptial agreement can protect what a party has made prior to the marriage and going forward, keep it as separate property, and limit or waive the right to spousal support," said Sussman.

Odom and Kardashian, however, may not be able to use a prenuptial or premarital agreement. Under California law, the bride or groom must have a draft of the agreement for seven days before they sign it. This is to ensure that they have enough time to read and understand the agreement and seek legal advice about it. "Given how quickly this relationship has moved, and given the decision to get married this Sunday, it is unclear whether they will have enough time to review a draft of a prenuptial agreement. If they don't, any prenuptial that is signed might be invalid."
