In a recent article in the Huffington Post Sue Manning states that in a 2006 survey by 1600 members of the American Academy of Matrimonial Lawyers that 25% said that they noticed an increase in pet custody cases since 2001. The article says that if there is a child involved many judges keep the pet with the child. In addition, with the "increase of same-sex marriages, civil unions and domestic partnerships are among reasons pet custody cases have become more common", cites Manning
Traditionally pets have been viewed as property and their division has not been given much attention by judges. The laws are changing and even under domestic violence statutes in California the court can order a restrained party to not sell etc. a pet and give that pet over to the other party. The article states that in the future there may be guidelines in awarding pets as there are in awarding children to parents. The law is shifting with the view of pets and we will keep you updated on it.
