Russell Brand and Katy Perry have been married for a little more than a year. The parties do not have any minor children. The issue will be if they do not have a premarital agreement monies and assets acquired during their union, and how they will split these. In California there is a community property presumption, that assets acquired during the marriage are community property and that these assets and debts must be divided evenly absent agreement to the contrary. The issue is whether or not one of them acquired significantly more assets and income than the other and if the spouse who acquired less is going to push for an even division if there is no premarital agreement.
Given the length of the marriage and the fact that they are both popular entertainers it is unlikely that either one of them will seek spousal support from the other going forward.
